Abstract
This paper examines the legality of eligibility denials based on unsportslike conduct and related due process concerns. Part I of this paper examines the definition and appeal processes for acts of unsportslike conduct as defined by the NCAA and select member conferences. Part II of this paper discusses the property right associated with athletic participation. Part III suggests that existing policies fail to provide adequate due process provisions. Part IV of this paper provides a recommended uniform unsportslike policy for adoption by the NCAA. Part V offers concluding comments.
